New Changes to Condominium Property Act Has Been Proclaimed
On June 5th, The Condominium Property Amendment Act, 2009 was proclaimed. This legislation and the regulations that support it are to better serve the needs of condominium developers, facilitating multi-use developments and will keep Saskatchewan in line with condominium trends across Canada.
Summary of Major Changes:
Title Parking Units: Developers will have the option to have titled parking units on a go-forward basis in new condominium developments. A conversion process for existing untitled parking spaces has not yet been established. However, efforts are being made to produce a process to convert untitled parking spaces in existing developments to titled parking units on an "on demand basis."
Titled Common property Developers will have the ability to title common property in the name of the condominium corporation. The resulting units, which are described in a condominium plan, will be called service units. Common property areas including laundry room, recreational facility, landscaping area, roadway, hallway or other area intended for the benefit and use of all the owners in the development
Combination Plans Surveyors will have the ability to include different types of condominium developments on the same plan of survey.
Sectors Condominium corporations will have the ability to form smaller groups called "sectors" to manage their own affairs.
